The OSHA Workers Page: You have a right to a safe and healthful workplace. That's why Congress passed the Occupational Safety and Health Act of 1970, requiring employers to provide workplaces free from recognized hazards. The Occupational Safety and Health Administration (OSHA) wants every worker to go home whole and healthy every day. The agency was created by Congress to help protect workers by setting and enforcing workplace safety and health standards and by providing safety and health information, training and assistance to workers and employers.

Filing a complaint with OSHA: If you would like to report hazards at your worksite to OSHA, or you have been discriminated against on the basis of safety and health issues, choose one of the following:

File a complaint, online if you believe your working conditions are unsafe or unhealthful. (Note: Most online complaints are addressed by OSHA's phone/fax system. That means they may be resolved informally over the phone with your employer. Written, signed complaints submitted to OSHA Area or State Plan offices are more likely to result in onsite OSHA inspections; see complaint handling process. Complaints from workers in OSHA-approved state plan states will be forwarded to the appropriate state plan for response.) If you are concerned about confidentiality, you may prefer to file your complaint from your home computer or a computer in your local library.

Download the OSHA complaint form, complete it and then fax or mail it to your local OSHA Regional Office or you may simply contact your local OSHA office to receive a copy of the complaint form. Be sure to include your name, address and telephone number so they can contact you.

OSHA Regulations - Employer responsibilities: Employers have certain responsibilities under the Occupational Safety and Health Act of 1970.

The following list is a summary of the most important ones.

Provide a workplace free from recognized hazards and comply with standards, rules and regulations issued under the OSHA Act.

bullet

Examine workplace conditions to make sure they conform to applicable OSHA standards.

bullet

Minimize or reduce hazards.

bullet

Make sure employees have and use safe tools and equipment and properly maintain this equipment.

bullet

Use color codes, posters, labels or signs to warn employees of potential hazards.

bullet

Establish or update operating procedures and communicate them so that employees follow safety and health requirements.

bullet

Provide medical examinations and training when required by OSHA standards.

bullet

Report to the nearest OSHA office within 8 hours any fatal accident or one that results in the hospitalization of three or more employees.

bullet

Keep records of work-related injuries and illnesses, and post a copy of the totals from the last page of the OSHA 200 Log during the entire month of February each year, if the employer has 11 or more employees.

Post, at a prominent location within the workplace, the OSHA poster (or the state-plan equivalent) informing employees of their rights and responsibilities.

Provide employees, former employees and their representatives access to the Log and Summary of Occupational Injuries and Illnesses (OSHA Form 200) at a reasonable time and in a reasonable manner.

Provide access to employee medical records and exposure records to employees or their authorized representatives.

bullet

Provide to the OSHA compliance officer the names of authorized employee representatives who may be asked to accompany the compliance officer during an inspection.

bullet

Not discriminate against employees who exercise their rights under the Act.

Post OSHA citations at or near the work area involved. Each citation must remain posted until the violation has been corrected, or for three working days, whichever is longer. Post abatement verification documents or tags.

Correct cited violations by the deadline set in the OSHA citation and submit required abatement verification documentation.
